CMS Delays Reporting for Liability Claims until 2012

The Center of Medicare and Medicaid Services (CMS) announced on November 9th that the requirement for reporting new liability claims, or be subject to fines, has been extended from the first quarter of 2011 to the first quarter of 2012.  This does not apply to claims with Ongoing Responsibility for Medical (ORM) claims.  It will apply to claims settled on or after 10/1/2011.  There has been no notice to date regarding any change for Workers’ Compensation claims, so at present all RREs should plan to start that process the first quarter of 2011.

The extension of reporting dates also extends the time frames for the dollar thresholds for Liability Insurance and Workers’ Compensation.  Through January, 2013, claims valued between $0 and $5,000 do not require reporting.  The levels decrease over the following two years.  The full schedule is available from CMS.
