Annual Legislative Recap: New Laws that Impact School Districts and County Offices of Education in 2024 and Beyond
The California legislature always manages to enact a “flurry” of bills with significant expansions of employee rights and associated employer risks in employment, education and public sector law. This year was no exception. This webinar will identify and explain the impact all the bills affecting the public sector, including expanded protected leaves, discrimination, harassment, and retaliation traps, workers’ compensation claim management, Education Code, public transparency, labor relations, and more. This webinar is customized for HR professionals, risk management specialists, CBO’s and administrators.
New and amended employment laws under the California Fair Employment & Housing Act, the Labor Code and other applicable laws affecting the public school/ public sector work environment. These new laws impact all employment processes: pre-employment procedures, broadened traps for the unwary with discrimination, harassment, and retaliation, harassment training requirements, mandated leaves of absence, and more.
- An array of new and amended provisions of the CA. Labor Code affecting workers’ compensation, retaliation, whistleblowers, caregiver responsibilities, and some mandated leaves of absence.
- New health and safety codes, including a major bill requiring significant expansions for Workplace Violence Prevention Programs and some new protocols for obtaining restraining orders.
- New and amended provisions of the Government Code affecting public employers’ and compliance requirements in transparency under the CA. Public Records Act.
- New additional protections for employees under the Fair Employment & Housing Act, preventing discrimination and harassment for additional protected categories.
- Yet another expansion of rebuttable presumptions of retaliation for adverse actions against workers under the California Labor Code.
- New leaves of absence for reproductive losses – miscarriage, failed adoptions, and more.
- Expansion of California’s paid sick leave law from 3 days/24 hours to 5 days/40 hours. This will affect substitutes, some temporary and seasonal workers, and others who work under your district’s paid sick leave law.
- New information on the bill passed last year regarding Cannabis and drug testing.
- A summary of the new requirements of the CA Fair Chance Act and its impact on public sector background checks and pre-employment processes (with an entire webcast on the details in November)
- New and amended provisions of the Education Code affecting certificated and classified employees, including impacts on paid and unpaid leaves, discipline and due process, and more.
- Amendments to the Education Code in the area of pupil health and safety that includes employee obligations and administrative oversight.
- New and amended provisions of the Education Code addressing a broad array of rights and responsibilities for students, many of which impact how administrators, teachers and staff interact with and serve the needs of general and special education students, This includes privacy rights for LGBTQ+ students, bullying and harassment prevention, and more.
