Overview
Join John Nichols, PRISM Senior Risk Control Specialist, for an engaging workshop, Beyond Low Bid Strengthening Outcomes in Public Contracting. Learn to identify pitfalls associated with "public-entity" contracting that contribute to defective bids, learn techniques and strategies to prevent bid defects and achieve a sound contracting process, and discuss means and methods to preserve the competitive bid. This is a 3-hour workshop (9 a.m. - 12 p.m.) and a networking lunch (12 p.m. -1:30 p.m.). Arrive early for coffee and breakfast treats.

Workshop Description:
When contracting for products and services “public entities” are required to accept the offer of the apparent low bidder, and some bidders will intentionally provide pricing below market value with the intent of forcing the public entity to renegotiate post contract award. This strategy is possible due to regulation intended to create fairness in contracting but can also be utilized by unscrupulous bidders to void the competitive bid under the guise of a defective scope of work, which creates considerable risk for public entities, including financial, reputation, and injury.
This presentation will identify pitfalls in “public contracting”, with an emphasis on scope of work and its impact on the competitive bid. Discussion will address trends among public works vendors utilizing California regulations to exploit bid document defects to manipulate pricing post award. The presentation will introduce compliant scope of work development procedures; provide effective strategies to prepare sound bid packages; identify tools to evaluate bid results pre-award; and acquaint participants with contract management means and methods essential to preserving the competitive bid.
